Terms and condition of sale

Scope and Application 

These terms and conditions (the “Conditions”) govern the services and products provided by Granit Design (Canada) and Granite Design USA (collectively “Granit Design,” “we,” “our”) in connection with countertop fabrication projects, including in particular the sale, project planning, measurement, fabrication, delivery, installation, and after-sales service.

Where the sale is concluded through an authorized distributor, the product sale contract is established between you and that distributor, under its own terms and conditions. These Conditions apply to the services rendered by Granit Design in carrying out your project and supplement, without replacing, your distributor’s terms and conditions.

Certain of our online tools (including our quoting and online purchase tools) are subject to their own specific terms of use or sale, presented directly within those tools. In the event of any conflict, those specific terms prevail over these Conditions with respect to the use of the relevant tool.

Definitions

  • “Client”: the individual or entity for whom the project is carried out;
  • “Distributor”: the retailer, kitchen designer, interior designer, or other authorized partner through whom the sale is concluded;
  • “Project”: all products and services provided by Granit Design, from design through to project completion;
  • “Quote”: the document describing the proposed products, services, specifications, and pricing.

Quotes and Pricing 

Every quote is prepared based on the information, plans, and specifications provided by the Client or their Distributor. Any changes to specifications, dimensions, selected material, or site conditions may result in a price adjustment.

3.1  Quote Validity

Quotes for residential projects are valid for a period of sixty (60) days from the date of issue. For commercial projects, contractor projects, and multi-unit residential projects, the validity period may vary depending on the type and scope of the project; in such cases, it is specified in the quote.

3.2  Currency and Taxes

Prices are expressed in Canadian dollars (CAD) for Projects carried out in Canada and in U.S. dollars (USD) for Projects carried out in the United States. In all cases, prices are stated exclusive of taxes; applicable taxes are added at the time of invoicing.

3.3  Price Adjustment and Final Price Confirmation

Until the final price is confirmed, Granit Design reserves the right to adjust its prices, in particular in the event of fluctuations in material costs or based on project-specific factors — such as out-of-zone travel, special cutouts, particular finishes, or difficult access — which are generally included in the quote.

Prices are adjusted following measurement, based on actual site conditions and final dimensions recorded on-site, and are officially confirmed following the final review conducted after the measurement appointment. The price confirmed at that stage constitutes the final price for the Project and may not be subsequently changed, except in the case of a Project modification requested by the Client (section 9) or site conditions that were not disclosed or were not reasonably detectable at the time of measurement.

Order, Material Selection, and Approvals 

The point at which an order becomes firm varies depending on the Distributor’s process: either upon receipt of the order by Granit Design, or upon acceptance of the quote by the Client or their Distributor. The Client is encouraged to confirm this milestone with their Distributor.

The final choice of material is the Client’s decision; our experts and Distributors can guide the Client toward the material best suited to their lifestyle. For stones with high variation (levels 3 and 4 on the Granit Design variation chart), it is recommended to plan all components of the Project at the same time (countertop, backsplash, thresholds, etc.), as a matching slab may be difficult to source after several months.

Layout approval by the Client (or their designated representative, including the Distributor), subject to additional fees, constitutes acceptance of the visual characteristics of the material and the seam placement shown therein. The Client acknowledges, however, that given the nature of the materials used in Projects — including the uniqueness of natural stones and the cutting, polishing, and processing involved — the final result may differ from the layout presented at approval. Visualization images and the approved layout represent the closest possible approximation but do not guarantee an exact 100% match with the finished product, particularly with respect to color nuances, veining, texture, and surface appearance, and such variations do not constitute a defect or grounds for refusing the Project.

Natural Characteristics of Materials 

5.1  Natural Stones

Each natural stone is a unique creation: no two slabs are identical, with veining, color nuances, and mineral content varying from block to block. These variations are what make natural stone beautiful and authentic and do not constitute defects. Granit Design classifies its stones according to a variation chart (levels 1 to 4); Clients who prefer a more uniform appearance are encouraged to consider a low-variation stone or a manufactured surface.

Stones are also subject to certain inherent phenomena — including micro-fissures, pitting, etching, and gloss variance — which are not defects but rather part of the uniqueness of natural stone.

5.2  Samples and Visualization Tools

A sample shows only a tiny portion of a slab: the greater the variation in the stone, the more samples may differ from each other and from the slab that will be used for the Project, particularly for exotic stones (variation levels 3 and 4). Samples, photographs, and visualization tools are provided for reference purposes only and cannot guarantee an exact match with the slab delivered.

5.3  Manufactured Materials (Mineral and Ultra-Compact Surfaces)

Mineral surfaces (quartz) and ultra-compact surfaces may also exhibit variations from samples, in accordance with the manufacturers’ tolerances for those materials. As certain colors are designed to imitate natural stone, the presence of random variations or impurities in the pattern is possible. For ultra-compact surfaces with a pattern printed on the surface, continuity of veining through the thickness of the slab is not typical: depending on the edge profile chosen, the edge may have a matte, solid-color finish, and pattern interruption at seams is possible. Our team can advise the Client on profiles and options to minimize these effects.

5.4  Finishes

Each material is available in one or more finishes. Certain finishes may be modified at the factory depending on the material, subject to feasibility review and additional fees; other materials, including ultra-compact surfaces, cannot have their finish reworked.

5.5 Seams

Depending on the size of the Project, seams may be required. Their number and placement are generally presented to the Client for reference purposes, in particular during the measurement appointment or at layout approval where applicable. This presentation does not, however, constitute a guarantee that seams will be placed exactly as shown: final placement is determined by our production team, which establishes the final seam layout in accordance with industry best practices and various technical factors, including slab dimensions, site constraints, and the color or movement inherent in the material. The final decision regarding seam placement rests with Granit Design. Granit Design adheres to industry standards for seams. Even when carefully executed, seams remain visible and perceptible to the touch; this is normal and does not constitute a defect.

5.6  Material Resistance

Materials are resistant to the elements but are never completely impervious to them. Each material has its own sensitivities (heat, scratches, acids, stains, freeze/thaw cycles, UV exposure, as applicable), which our teams and Distributors can explain to the Client to help guide their selection and care decisions.

Measurement and Site Conditions 

Measurements are taken by Granit Design. Appointments are scheduled during business hours, and the Client must allow a time window for the technician’s arrival. To ensure template accuracy and adherence to timelines, the site must be ready at the time of the appointment.

6.1  Site Preparation

Prior to the measurement appointment, the Client must ensure that:

  • All surfaces to be measured are completely clear of any objects to allow for accurate measurement;
  • All items to be installed on or near the countertop (sink, faucet, dispensers, appliances, etc.) are on-site;
  • Farmhouse (apron-front) sinks are installed in the cabinet;
  • Where the Project includes overhangs requiring supports and the Client chooses to install the brackets or corbels themselves, these are installed;
  • If the Client does not wish the countertop to be notched around a window or door casing, the casing has been modified in advance (casings are not modified by Granit Design, and the countertop will otherwise be notched to accommodate them);
  • Children and pets can be kept away from the work area throughout the duration of the appointment.

6.2  Client Responsibilities Prior to Measurement

The Client and the site are considered “ready” only when ALL of the following conditions are met:

  • The site is fully accessible to our technicians, with no other trades or ongoing work blocking access;
  • An individual authorized to make decisions is present on-site to answer questions and approve project details;
  • Cabinets are installed, secured, level, and plumb (except for the F.I.T.Parfait™ Process);
  • All accessories are selected and available on-site (sink, faucet, etc.), or their complete specifications have been provided and incorporated into the Project file.

If any of these conditions is not met, the site is not considered ready and the measurement appointment will need to be rescheduled. In such case, the appointment may be rescheduled subject to our teams’ availability, and fees may apply.

6.3  Measurement Appointment Process

During the measurement appointment, the technician reviews the project details with the Client, including seam and cutout placement. Final seam placement is determined in accordance with industry best practices, based on the color, stability, and dimensions of the material as well as handling constraints on-site.

Granit Design recommends against reusing existing plumbing accessories (sink, faucet, garburator), as these may be damaged during removal. No warranty applies to reused accessories.

6.4  Final Template and Subsequent Modifications

The template produced during the measurement appointment takes precedence over all prior plans, drawings, and estimates. The Project is fabricated based on this template. Any modification requested after the measurement appointment may require a new measurement appointment, and additional fees may apply.

6.5  Cancellation or Rescheduling Fees for a Measurement Appointment

The following fees apply in the event of cancellation or rescheduling of a measurement appointment at the Client’s initiative, or when the site is not ready at the time of the appointment:

  • Cancellation or rescheduling less than 48 hours before the appointment: fees will apply. The applicable amount is established in accordance with the terms agreed upon with the Distributor; the Client is encouraged to confirm this amount with their Distributor;
  • Cancellation, rescheduling, or site not ready on the day of the appointment: fees will apply. The applicable amount is established in accordance with the terms agreed upon with the Distributor; the Client is encouraged to confirm this amount with their Distributor.

6.6  Perfect F.I.T.™ Process

The Perfect F.I.T.™ Process, which allows for countertop installation within 24 business hours following cabinet installation, is offered under certain conditions. To confirm your eligibility and the applicable terms, please contact our team.

Delivery and Installation 

Delivery and installation are carried out by Granit Design teams or its authorized subcontractors. The Client must ensure free and safe access to the installation site.

7.1  Pre-Installation Conditions

The Client and the Project are considered “ready for installation” only when ALL of the following conditions are met:

  • An authorized adult is present on-site to conduct the final inspection and approve the work;
  • The Project follows the normal production flow, meaning: measurement has been completed (or plans have been provided, in the case of a plans-only project); no Client-initiated modifications are in progress; and the raw material is available (standard program material, not out of stock);
  • The required deposit has been paid, where applicable;
  • Final payment has been made to the Distributor or retailer and the purchase order payment has been received, where applicable;
  • Plumbing will be disconnected;
  • Existing countertops will be removed prior to our teams’ arrival, unless the Client has opted for our “Countertop Removal” option;

All accessories will be available on-site, particularly undermount sinks.

If any of these conditions is not met, the Project is not considered ready and the installation date will need to be rescheduled.

7.2  Client Responsibilities Prior to Installation

To ensure the smooth progress of installation, the Client must:

  • Completely clear all work surfaces and remove the contents of lower cabinets, drawers, and any fragile items near the installation area;
  • Protect adjacent living areas, including by covering and protecting floors along the path leading to the installation area, and create a clear and unobstructed passage from the entrance to that area. Floor and living area protection is the Client’s responsibility;
  • Ensure that the relevant appliances are on-site but not yet installed;
  • Ensure that no other ongoing work on the site conflicts with the installation;
  • Defer final wall finishing (painting, wallpaper application, final sanding) until after installation, as touch-ups may be necessary following the work.

7.3  Delivery and Installation Timelines

Communicated dates are established in good faith based on production planning and site conditions. As construction work is involved, these timelines are provided for informational purposes only and do not constitute a firm commitment: circumstances beyond Granit Design’s control (including transportation delays, raw material availability, or breakage during fabrication) may cause rescheduling. No penalty or compensation may be claimed as a result of a postponed delivery or installation date.

7.4  Excluded Related Work

The following work is not part of Granit Design’s services and remains the Client’s responsibility: plumbing (disconnection and reconnection), electrical work, wall or paint touch-ups, and the removal and disposal of existing countertops. Granit Design can, upon request, take charge of removing existing countertops; this option is offered for an additional fee.

7.5  Minor Damages Inherent to Installation

Despite the care taken by our teams, countertop installation involves handling heavy pieces in confined spaces and may result in minor damage (including scratches, scuffs, or marks to walls, floors, cabinets, or the existing backsplash, or plastering or paint touch-ups required). Such minor damage is considered inherent to this type of construction work; Granit Design is not required to repair it or compensate the Client in this regard, and any resulting touch-ups remain the Client’s responsibility. This is also why final wall finishing (painting, wallpaper application, final sanding) should be deferred until after installation. Any damage observed may be reported directly to our technicians on-site or to your account manager.

7.6  Work Acceptance

Upon completion of the work, a seam inspection is carried out with the Client (or the authorized adult present), who is then invited to sign the work acceptance document confirming their satisfaction with the quality, fit, and condition of the countertops. This is the ideal moment to ask any questions or raise any concerns before our teams depart.

7.7  Cancellation or Rescheduling Fees for an Installation Appointment

The following fees apply in the event of cancellation or rescheduling of an installation appointment at the Client’s initiative, or when the site is not ready at the time of the appointment:

  • Cancellation or rescheduling less than 48 hours before the appointment: fees will apply. The applicable amount is established in accordance with the terms agreed upon with the Distributor; the Client is encouraged to confirm this amount with their Distributor;
  • Cancellation, rescheduling, or site not ready on the day of the appointment: fees will apply. The applicable amount is established in accordance with the terms agreed upon with the Distributor; the Client is encouraged to confirm this amount with their Distributor.

Pricing, Payment Terms, and Default 

8.1  Invoicing and Payment Terms

Where the Project is concluded through a Distributor, the Distributor invoices the Client directly. The applicable payment structure — including the required deposit, the timing of the balance payment, and accepted payment methods — is that set out in the contract and the terms agreed upon between the Client and their Distributor. The Client is encouraged to refer to their Distributor’s terms for any questions regarding invoicing and payment for their Project.

8.2  Late Payment and Default

Interest and fees applicable in the event of late payment, as well as the consequences of default, are governed by the contract and the terms agreed upon with the Distributor. Granit Design nonetheless reserves the right to suspend fabrication, delivery, or installation of a Project for which required payments have not been received, in accordance with the conditions set out in section 7 (“Pre-Installation Conditions”).

8.3  Reservation of Title

Products remain the property of Granit Design until full payment of the price therefor has been received. Granit Design also reserves all remedies available to it under applicable law in the event of non-payment, including, where applicable, the legal construction hypothec in Québec and mechanic’s lien remedies applicable in the U.S. state where the Project is carried out.

Modifications and Cancellation 

9.1  Project Modifications 

Any request for modification must be communicated as early as possible to Granit Design or the Distributor, as applicable. The following terms apply depending on the stage of the Project: 

  • Before measurement: modifications to specifications, dimensions, or material selection can generally be incorporated into the Project file; however, they may result in a price adjustment in accordance with section 3.
  • After measurement: as the template takes precedence over all prior plans and drawings (section 6), any modification may require a new measurement appointment and additional fees may apply. A modification in progress also suspends the normal production flow and may postpone the installation date (section 7).
  • After fabrication has begun: given the custom nature of Projects, fabricated to the exact specifications of the approved template, certain modifications may be impossible once fabrication has commenced. Where a modification remains feasible, all resulting costs (additional raw material, re-fabrication, delays) are borne by the Client.

9.2  Project Cancellation 

Where the sale was concluded through a Distributor, any request to cancel the Project must be directed to the Distributor and is governed by the contract and terms agreed upon between the Client and the Distributor, including with respect to the refund of any deposit or payment made. 

The Client is advised that Projects are custom products, fabricated to the unique specifications of their site, and cannot be resold or repurposed by Granit Design. In this context, it is possible that certain fees or payments may not be refundable. Each cancellation request is assessed on a case-by-case basis, in light of the Project’s progress at the time of the request, including the stages already completed and the costs already incurred (measurement, raw material reservation, fabrication commenced or completed). 

9.3  Appointment Cancellation or Rescheduling 

The cancellation or rescheduling of a measurement or installation appointment is subject to the fees set out in sections 6 and 7. 

9.4  Statutory Rights 

Nothing in this section limits any mandatory cancellation or rescission rights that a consumer Client may have under applicable laws in their jurisdiction. 

Warranties 

The warranties offered by Granit Design are in addition to applicable statutory warranties, which remain in force, including the legal warranty of quality under the Civil Code of Québec and the Consumer Protection Act for Québec consumer clients, as well as the mandatory warranties provided by the laws of the U.S. state where the Project is carried out.

10.1  Granit Design Warranties

Granit Design offers the following warranties, calculated from the date of installation:

  • Seam Performance – 1 year: seam performance is warranted for one (1) year from the date of installation. Beyond this period, any separation, opening, or cracking, whether or not related to a structural change, misuse, or surface abuse, is not covered. The aesthetic appearance of seam is never covered by warranty, unless the original installation does not meet industry standards. Where a silicone finish is applied between the countertop and the wall, it is applied at the discretion of the installation technician; it does not constitute a seam and is not covered by any warranty.
  • Undermount Sink or Lavatory Installation – 1 year: adhesive performance is warranted for one (1) year from the date of installation.
  • Exclusive GDGuard™ Anti-Stain Treatment – 15 years: where the Client opts for this treatment, Granit Design warrants the surface against food and beverage stains for fifteen (15) years (applicable to granite and quartzite stones only). Untreated natural stones carry no warranty against staining.

10.2  Manufacturer Warranties

Mineral surfaces (quartz) and ultra-compact surfaces are covered by the warranties of their respective manufacturers; the Client is encouraged to refer to the warranty documents for the material selected.

10.3 Exclusions

No material is warranted against cracks, fractures, scratches, discoloration, chips, or other damage that may result from regular use, structural movement, or prolonged exposure to the elements. The following also do not constitute defects covered by warranty:

  • The natural and inherent characteristics of materials described in section 5 (variations in color, veining, or texture, micro-fissures, pitting, etching, gloss variance, presence of seams), as well as discrepancies between the finished product and the approved layout as contemplated in section 4;
  • Chips, regardless of cause. The Chip Minimizer option can significantly reduce the risk in sensitive areas, such as the sink perimeter, but does not constitute a warranty;
  • Damage resulting from thermal shock, misuse, abuse, or inadequate surface care;
  • Damage to reused plumbing accessories, in accordance with section 6;
  • Minor damage inherent to installation work as contemplated in section 7;
  • Care products sold by Granit Design, which carry no warranty.

10.4 Care and Maintenance

Materials are resistant to the elements but are never completely impervious to them. The Client is responsible for maintaining their surface in accordance with the care recommendations applicable to the material selected. Natural stones treated with the GDGuard™ treatment require no additional sealant; for untreated natural stones, periodic application of an impregnating sealer is recommended to maintain stain resistance. 10.5  Claims and Service Calls

For any questions or service call requests, the Client may contact the Granit Design team at 1-877-373-7111. The majority of countertops can be repaired; depending on the nature of the work (including restoration of chips not covered by warranty), travel and craftsperson fees may apply.

Where a claim is covered by warranty, Granit Design reserves the right to determine the appropriate method of correction and to proceed, at its discretion, with repairing the affected surface rather than replacing it. A repair carried out in accordance with industry best practices constitutes valid performance of the warranty. Replacement is considered only where repair cannot be satisfactorily achieved in accordance with industry standards.

Limitation of Liability 

To the extent permitted by law, Granit Design’s liability is limited to direct and foreseeable damages arising from its fault. Nothing in these Conditions has the effect of excluding or limiting any liability that cannot be excluded or limited under applicable law, including with respect to consumer clients.

Force majeure 

Granit Design shall not be held liable for delays or non-performance resulting from a force majeure event or circumstances beyond its reasonable control, including: extreme weather conditions, material supply disruptions, labour disputes, major outages, fire, or governmental requirements. Timelines are then extended for a reasonable period and the parties agree in good faith on the necessary adjustments.

Personal Information 

The personal information collected in connection with the Project is handled in accordance with our Privacy Policy, available on our websites. By entrusting your Project to Granit Design, directly or through a Distributor, you acknowledge that the information necessary for its completion may be transmitted to us and used for the purposes described therein.

Intellectual Property 

The plans, drawings, templates, layouts, trademarks (including Perfect F.I.T.™), content, and tools developed by Granit Design remain its exclusive property. They may not be reproduced or used for any purpose other than the completion of the Project without written authorization. The Client authorizes Granit Design to photograph the completed Project for quality control purposes; any promotional use of such photos is subject to the Client’s consent in accordance with our Privacy Policy.

Governing Law and Dispute Resolution 

For Projects carried out in Canada, these Conditions are governed by the laws applicable in the province or territory where the Project is carried out, and, for Projects carried out in Québec, by the laws of Québec. For Projects carried out in the United States, they are governed by the laws of the state where the Project is carried out. The mandatory consumer protection provisions of the Client’s jurisdiction remain applicable, including with respect to the competent tribunal.

Terms Applicable to Online Tools 

Granit Design makes various online tools available to its clients and Distributors. The use of these tools may be subject to specific terms of use or sale, presented directly within the relevant tool, at the time of its use or of the transaction. The Client is encouraged to review these terms before using the tool or finalizing a transaction.

These specific terms supplement these Conditions and, in the event of any conflict, prevail over these Conditions with respect to the use of the relevant tool. For everything not addressed by those specific terms, these Conditions continue to apply.

General Provisions 

If any provision of these Conditions is found to be invalid or unenforceable, the remaining provisions continue in full force and effect. Granit Design’s failure to exercise a right does not constitute a waiver thereof. These Conditions, together with the accepted Quote and any document expressly incorporated herein, constitute the entire agreement between the parties with respect to Granit Design’s services. Granit Design may amend these Conditions; the version applicable to a Project is that in effect at the time of order confirmation.
